Nokia and AT and T accused of selling used phones

Nokia and AT and T have been named co-defendants in a class action suit alleging a used cellphone was sold as new by a California store.

The suit against Nokia, AT&T Mobility and CommClub was originally filed in Los Angeles Superior Court, only to be recently transferred to a federal court.

The 27-page complaint filed by lawyers of Gregg Farley and Michels & Watkins in Los Angeles say “in fact, the lawsuit has already suffered injuries and lost money or property as a result of the acts in that members of the class paid the purchase price for a new Nokia mobile phone and instead received a used or reconditioned Nokia handset that was worth substantially less.”

An AT&T Mobility spokesman said “this is a procedural step to move the case from state court to federal court. Beyond that we have no further comment on this pending litigation.”
